4. hosting and content delivery networks (CDN)
External hosting
This website is hosted by an external service provider in Germany (hoster). The personal data collected on this website is stored on the hoster’s servers. This may include IP addresses, contact requests, meta and communication data, contract data, contact data, names, website accesses and other data generated via a website.
The hoster is used for the purpose of fulfilling the contract with our potential and existing customers (Art. 6 para. 1 lit. b DSGVO) and in the interest of a secure, fast and efficient provision of our online offer by a professional provider (Art. 6 para. 1 lit. f DSGVO).
Our hoster will only process your data to the extent necessary to fulfill its service obligations and follow our instructions regarding this data.
Conclusion of a contract on commissioned processing
In order to ensure data protection-compliant processing, we have concluded an order processing contract with our hoster.
SSL or TLS encryption
For security reasons and to protect the transmission of confidential content, such as orders or requests that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.
If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.
5. Cookies
Our Internet pages use so-called “cookies”. Cookies are small text files and do not cause any damage to your terminal device. They are stored either temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your end device. Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your terminal device until you delete them yourself or until they are automatically deleted by your web browser.
In some cases, cookies from third-party companies may also be stored on your terminal device when you enter our site (third-party cookies). These enable us or you to use certain services of the third-party company (e.g. cookies for processing payment services).
Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies are used to evaluate user behavior or display advertising.
Cookies that are necessary to carry out the electronic communication process (necessary cookies) or to provide certain functions that you have requested (functional cookies, e.g. for the shopping cart function) or to optimize the website (e.g. cookies to measure the web audience) are stored on the basis of Art. 6 (1) lit. f DSGVO, unless another legal basis is specified. The website operator has a legitimate interest in storing cookies for the technically error-free and optimized provision of its services. If consent to the storage of cookies has been requested, the storage of the cookies in question is based exclusively on this consent (Art. 6 para. 1 lit. a DSGVO); consent can be revoked at any time.
You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.
Insofar as cookies are used by third-party companies or for analysis purposes, we will inform you separately about this within the scope of this data protection declaration and, if necessary, request your consent.
Cookie consent with Borlabs cookie
Our website uses the cookie consent technology of Borlabs Cookie to obtain your consent to the storage of certain cookies in your browser and to document this in accordance with data protection. The provider of this technology is Borlabs – Benjamin A. Bornschein, Georg-Wilhelm-Str. 17, 21107 Hamburg (hereinafter referred to as Borlabs).
When you enter our website, a Borlabs cookie is stored in your browser, in which the consents you have given or the revocation of these consents are stored. This data will not be shared with the Borlabs cookie provider.
The collected data will be stored until you request us to delete it or until you delete the Bor-labs cookie yourself or until the purpose for storing the data no longer applies. Mandatory legal retention periods remain unaffected. Details on the data processing of Bor-labs Cookie can be found at https://de.borlabs.io/kb/welche-daten-speichert-borlabs-cookie/.
Borlabs Cookie Consent Technology is used to obtain the legally required consent for the use of cookies. The legal basis for this is Art. 6 para. 1 p. 1 lit. c DSGVO.
6. general data processing on the website
(Excluding web analytics, web tracking, cookies, newsletters and social media plug-ins).
6.1 Contact form
If you send us inquiries via the contact form, your data from the inquiry form, including the contact data you provided there, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not pass on this data without your consent.
The processing of this data is based on Art. 6 (1) lit. b DSGVO, if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the inquiries directed to us (Art. 6 para. 1 lit. f DSGVO) or on your consent (Art. 6 para. 1 lit. a DSGVO) if this was requested.
The data you entered in the contact form will remain with us until you request us to delete it, revoke your consent to store it, or the purpose for storing the data no longer applies (e.g. after we have completed processing your request). Mandatory legal provisions – in particular retention periods – remain unaffected.
6.2 Inquiry by e-mail, telephone or fax
If you contact us by e-mail, telephone, fax, mail or in any other way, your inquiry including all personal data resulting from it (name, inquiry) will be stored and processed by us for the purpose of processing your request. We will not pass on this data without your consent.
The data you send us via contact requests will remain with us until you request us to delete it, revoke your consent to store it or the purpose for storing the data no longer applies (e.g. after your request has been processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.
7. Newsletter
7.1 Newsletter data
If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. Further data is not collected or only on a voluntary basis. We use this data exclusively for sending the requested information and do not pass it on to third parties.
The data entered in the newsletter registration form is processed exclusively on the basis of your consent (Art. 6 para. 1 lit. a DSGVO). You can revoke your consent to the storage of the data, the e-mail address and their use for sending the newsletter at any time in the future, for example via the “unsubscribe” link in the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.
The data you provide for the purpose of receiving the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list after you unsubscribe from the newsletter. Data that has been stored by us for other purposes remains unaffected by this.
After you have unsubscribed from the newsletter distribution list, your e-mail address may be stored by us or the newsletter service provider in a blacklist in order to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be merged with other data. This serves both your interest and our interest in complying with the legal requirements for sending newsletters (legitimate interest within the meaning of Art. 6 Para. 1 lit. f DSGVO). The storage in the blacklist is not limited in time. You may object to the storage if your interests outweigh our legitimate interest.
7.2 CleverReach
This website uses CleverReach to send newsletters. The provider is Cle-verReach GmbH & Co. KG, Mühlenstr. 43, 26180 Rastede. CleverReach is a service with which the newsletter dispatch can be organized and analyzed. The data you enter for the purpose of receiving newsletters (e.g. e-mail address) is stored on CleverReach’s servers in Germany or Ireland.
Our newsletters sent with CleverReach allow us to analyze the behavior of newsletter recipients. Among other things, we can analyze how many recipients have opened the newsletter message and how often which link in the newsletter was clicked. With the help of so-called conversion tracking, it can also be analyzed whether a predefined action (e.g. purchase of a product on this website) has taken place after clicking on the link in the newsletter. For more information on data analysis by Cle-verReach newsletter, please visit: https://www.cleverreach.com/de/funktionen/reporting-und-tracking/.
The data processing is based on your consent (Art. 6 para. 1 lit. a DSGVO). You can revoke this consent at any time for the future by unsubscribing from the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.
If you do not want any analysis by CleverReach, you must unsubscribe from the newsletter. For this purpose, we provide a corresponding link in each newsletter message. Furthermore, you can also unsubscribe from the newsletter directly on the website.
The data you provide for the purpose of receiving the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list after you unsubscribe.
You can object to the storage if your interests outweigh our legitimate interest.

8. Analysis tools and advertising
8.1 Google Analytics
This website uses functions of the web analysis service Google Analytics. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.
Google Analytics enables the website operator to analyze the behavior of website visitors. In doing so, the website operator receives various usage data, such as page views, dwell time, operating systems used and the origin of the user. This data may be summarized by Google in a profile that is assigned to the respective user or their end device.
Google Analytics uses technologies that enable the recognition of the user for the purpose of analyzing user behavior (e.g. cookies or device fingerprinting). The information collected by Google about the use of this website is usually transferred to a Google server in the USA and stored there.
The use of this analysis tool is based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in analyzing user behavior in order to optimize both its website and its advertising. If a corresponding consent has been requested (e.g. consent to store cookies), the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a DSGVO. You can revoke your consent at any time for the future.
IP anonymization
We have activated the IP anonymization function on this website. This means that your IP address is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with any other data held by Google.
Browser Plugin
You can prevent the collection and processing of your data by Google by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de.
For more information on how Google Analytics handles user data, please see Google’s privacy policy: https://support.google.com/analytics/answer/6004245?hl=de.
Order processing
We have concluded an order processing agreement with Google and fully implement the strict requirements of the German data protection authorities when using Google Analytics.
Storage duration
Data stored by Google at user and event level that is linked to cookies, user identifiers (e.g. User ID) or advertising IDs (e.g. DoubleClick cookies, Android advertising ID) is anonymized or deleted after 14 months. For details, please see the following link: https://support.google.com/analytics/answer/7667196?hl=de
8.2 Matomo (formerly Piwik)
This website uses the open source web analytics service Matomo. Matomo uses technologies that enable the cross-page recognition of the user to analyze user behavior (e.g. cookies or device fingerprinting). The information collected by Matomo about the use of this website is stored on our server. The IP address is anonymized before storage.
The use of this analysis tool is based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in the anonymized analysis of user behavior in order to optimize both its website and its advertising. If a corresponding consent has been requested (e.g. consent to store cookies), the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a DSGVO; the consent can be revoked at any time for the future.
The information collected by Matomo about the use of this website will not be disclosed to third parties.
9. Plugins and tools
9.1 YouTube with extended data protection
This website embeds videos of YouTube. The operator of the pages is Google Ireland Li-mited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.
We use YouTube in the extended data protection mode. According to YouTube, this mode causes YouTube not to store information about visitors to this website before they watch the video. However, the transfer of data to YouTube partners is not necessarily excluded by the extended data protection mode. Thus, YouTube – regardless of whether you watch a video – establishes a connection to the Google Double Click network.
As soon as you start a YouTube video on this website, a connection to the YouTube servers is established. This tells the YouTube server which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to assign your surfing behavior directly to your personal profile. You can prevent this by logging out of your YouTube account.
Furthermore, YouTube can save various cookies on your end device after starting a video or use comparable recognition technologies (e.g. device fingerprinting). In this way, YouTube can obtain information about visitors to its website. This information is used, among other things, to collect video statistics, improve the user experience, and prevent fraud attempts.
If necessary, further data processing operations may be triggered after the start of a YouTube video, over which we have no control.
YouTube is used in the interest of an appealing presentation of our online offers. This represents a legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO. If a corresponding consent was requested, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a DSGVO; the consent can be revoked at any time for the future.
If you do not use this service, this will not affect the functionality and information flow of our website. You thereby exclude the further processing of your data by YouTube.
You can find more information about data protection at YouTube in their data protection statement at: https://policies.google.com/privacy?hl=de.
9.2 Google Web Fonts
This site uses so-called web fonts provided by Google for the uniform display of fonts. The Google Fonts are installed locally. A connection to Google servers does not take place.
Further information on Google Web Fonts can be found at https://developers.google.com/fonts/faq and in Google’s privacy policy: https://policies.google.com/privacy?hl=de.
9.3 Google Maps
This site uses the map service Google Maps via an API. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.
To use the functions of Google Maps, it is necessary to save your IP address. This information is usually transmitted to a Google server in the USA and stored there. The provider of this site has no influence on this data transfer. Please refrain from using Google Maps if you do not wish to consent to the further use of your data by Google Maps.
The use of Google Maps is in the interest of an appealing presentation of our online offers and an easy location of the places indicated by us on the website. This represents a legitimate interest within the meaning of Art. 6 Para. 1 lit. f DSGVO. If a corresponding consent was requested, the processing is based exclusively on Art. 6 para. 1 lit. a DSGVO; the consent can be revoked at any time.
More information on the handling of user data can be found in Google’s privacy policy: https://policies.google.com/privacy?hl=de.
10. Handling of applicant data
We offer you the opportunity to apply to us (e.g. by e-mail, post or via online application form). In the following, we inform you about the scope, purpose and use of your personal data collected during the application process. We assure you that your data will be collected, processed and used in accordance with applicable data protection law and all other statutory provisions and that your data will be treated in strict confidence.
Scope and purpose of data collection
If you send us an application, we will process your associated personal data (e.g. contact and communication data, application documents, notes taken during interviews, etc.) insofar as this is necessary to decide on the establishment of an employment relationship. The legal basis for this is Section 26 of the German Federal Data Protection Act (BDSG) (initiation of an employment relationship), Article 6 (1) (b) of the German Data Protection Regulation (DSGVO) (general contract initiation) and – if you have given your consent – Article 6 (1) (a) of the DSGVO. The consent can be revoked at any time. Your personal data will only be passed on within our company to persons who are involved in processing your application.
If your application is successful, the data you submitted will be stored in our data processing systems on the basis of Section 26 of the German Federal Data Protection Act (BDSG) and Article 6 (1) (b) of the German Data Protection Act (DSGVO) for the purpose of implementing the employment relationship.
Retention period of the data
If we are unable to make you a job offer, if you reject a job offer or if you withdraw your application, we reserve the right to retain the data you have submitted for up to 6 months from the end of the application process (rejection or withdrawal of the application) on the basis of our legitimate interests (Art. 6 Para. 1 lit. f DSGVO). The data will then be deleted and the physical application documents destroyed. This storage serves in particular as evidence in the event of a legal dispute. If it is apparent that the data will be required after the 6-month period has expired (e.g. due to an impending or pending legal dispute), the data will not be deleted until the purpose for which it was retained no longer applies.
Longer storage may also take place if you have given your consent (Art. 6 Para. 1 lit. a DSGVO) or if legal storage obligations prevent deletion.
Inclusion in the applicant pool
If we do not make you a job offer, it may be possible to include you in our applicant pool. In the event of inclusion, all documents and details from the application will be transferred to the applicant pool in order to contact you in the event of suitable candidates.
Inclusion in the applicant pool is based exclusively on your express consent (Art. 6 Para. 1 lit. a DSGVO). The provision of consent is voluntary and is not related to the current application process. The data subject may revoke his/her consent at any time for the future. In this case, the data from the applicant pool will be irrevocably deleted, unless there are legal reasons for retention.
The data from the applicant pool will be irrevocably deleted no later than two years after consent has been given. A regular comparison of the further use of your data will take place within this period.
10 Data transfer and recipients
As a rule, your personal data will not be passed on to third parties, unless
– we have explicitly pointed this out in the description of the respective data processing,
– you have given your express consent in accordance with Art. 6 Para. 1 S. 1 lit. a DSGVO,
– the disclosure is necessary for the assertion, exercise or defense of legal claims pursuant to Art. 6 (1) sentence 1 lit. f DSGVO or is in our legitimate interest for other reasons and there is no reason to assume that you have an overriding legitimate interest in the non-disclosure of your data,
– there is a legal obligation for the disclosure according to Art. 6 para. 1 sentence 1 lit. c DSGVO and
– this is necessary according to Art. 6 para. 1 p. 1 lit. b DSGVO for the processing of contractual relationships with you.
If we use external service providers in individual cases, we ensure that appropriate technical and organizational measures are implemented and necessary agreements are concluded in such a way that the processing is carried out in accordance with the applicable data protection regulations and guarantees the protection of the rights of the data subject.
11 Duration of the storage of personal data
The duration of the storage of personal data is measured by the relevant statutory retention obligations, e.g. from commercial law and tax law. After expiry of the respective period, the corresponding data is routinely deleted. If data is required for the fulfillment or initiation of a contract or if we have a legitimate interest in continuing to store it, the data will be deleted when it is no longer required for these purposes or you have exercised your right of revocation or objection.
12. Your rights
You have the following rights when your personal data is collected:
(1) The right to request information about your personal data processed by us in accordance with Art. 15 DSGVO. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data, if it was not collected by us, as well as the existence of automated decision-making, including profiling, and, if applicable, meaningful information about its details.
(2) The right, in accordance with Art. 16 DSGVO, to demand the immediate correction of incorrect or completion of your personal data stored by us.
(3) The right to request the erasure of your personal data stored by us in accordance with Article 17 of the GDPR, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defense of legal claims.
(4) The right to request the restriction of the processing of your personal data in accordance with Art. 18 DSGVO, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure and we no longer need the data, but you need it for the assertion, exercise or defense of legal claims or you have objected to the processing in accordance with Art. 21 DSGVO.
(5) The right, pursuant to Art. 20 DSGVO, to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request that it be transferred to another controller.
(6) Right to revoke consent given in accordance with Art. 7 (3) DSGVO. You have the right to revoke consent to the processing of data given once at any time with effect for the future. In the event of revocation, we will immediately delete the data concerned, unless further processing can be based on a legal basis for processing without consent. The revocation of consent shall not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.
(7) The right to complain to a supervisory authority pursuant to Art. 77 DSGVO. As a rule, you can contact the supervisory authority of the federal state of our registered office stated above or, if applicable, that of your usual place of residence or workplace. The contact details of the supervisory authority responsible for us can be found in section 1 of this declaration, under “Contact details of the responsible supervisory authority”.
Right of objection
If your personal data is processed by us on the basis of legitimate interests pursuant to Art. 6 (1) p. 1 lit. f DSGVO, you have the right to object to the further processing of your personal data pursuant to Art. 21 DSGVO, insofar as this is done for reasons arising from your particular situation. To the extent that the objection is directed against the processing of personal data for the purpose of direct marketing, you have a general right of objection without the requirement to specify a particular situation.
If you wish to exercise your right of revocation or objection, it is sufficient to send an
e-mail to: info@diamant-polymer.de.
13. Objection to advertising e-mails
We hereby object to the use of contact data published within the framework of the imprint obligation for the transmission of advertising and information material not expressly requested. The operators of the pages expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, such as spam e-mails.
14. Changes to our data protection declaration
We reserve the right to update this data protection declaration if necessary, in compliance with the applicable data protection regulations. In this way, we can adapt it to the current legal requirements and take into account changes to our services, e.g. when introducing new services. The current version applies to your visit.
